| 摘 要： | 当儿童失踪达到法定期限被宣告死亡时,由于我国实行计划生育的基本国策,对父母的再生育问题,立法机关应慎重考虑.被宣告死亡者的父母没有非法生育,并履行一系列严格的程序后,可以再生育.

| Abstract: | When the sum of the missing days of a missing child is up to the statutor deadline , as China's basic national policy of family planning, legislature should take their patents'right of re-birth sefioasly. If their parents,birth is legal,after carrying out a series of strict procedures,their parents can be re-birth. |
